Welcome to YILDIZ OCEANIC WELL-BEING. These Terms of Service ("Terms") govern your use of our website, [yildizoceanicwellbeing.com] (the "Site"), which is hosted on the Squarespace platform and owned by YILDIZ OCEANIC WELL-BEING ("we," "us," "our").

1. Services Provided

·       We offer well-being coaching services, consultations, and digital coaching packages for informational and educational purposes.

·       Coaching is not medical, psychological, or psychiatric treatment. It does not diagnose, treat, or prevent any medical condition and is not a substitute for professional healthcare.

·       Coaching is intended for general wellness and personal development. Always consult your healthcare provider before starting any new regimen.

·       Clients acknowledge that participation in coaching is voluntary and that they remain responsible for their own decisions, actions, and well-being throughout the process.

·       Coaching may involve goal setting, self-reflection, habit exploration, and wellness education. It is not intended to replace licensed medical care or professional mental health services.

·       In the event a client exhibits signs of distress or indicates a need beyond the scope of coaching, we reserve the right to refer the client to appropriate resources, including a licensed healthcare provider or mental health professional.

·       While Yildiz Oceanic Well-Being is not a HIPAA-covered entity yet, all client information is handled confidentially using best practices for protecting client privacy and secure communication.

·       By engaging with our services, clients provide informed consent, acknowledge and agree to the professional boundaries of the coaching relationship.

2. Eligibility

You must be 18 years or older to use our services or make purchases through the Site.

3. Booking & Payments

·       Clients may schedule free consultations. After free consultation and based on mutual agreement, they may proceed to purchase coaching packages through the Site.

·       Please do not purchase any package prior to completing the free consultation.

·       Payments are securely processed via Squarespace’s integrated payment providers (e.g., Stripe, PayPal).

·       1-Month Package requires full payment upon booking.

·       3-Month Package offers either a one-time payment or two monthly installments.

·       6-Month Package is available only to clients who have completed the 3-Month Package and may be paid via one-time payment or in multiple installments depending on the continuation plan.

·       Bonus sessions are available only for clients who complete payment in full at the time of purchase.

·       Coaching agreement and payment plans must be completed on schedule to maintain access to sessions.

·       All sessions (package, bonus, individual, or check-ins) are scheduled by the Client through a designated booking system.

4. Cancellations & Refunds

  • Session Cancellation & Rescheduling

-    All sessions must be scheduled at least 48 hours in advance.

-    Clients must cancel or reschedule sessions at least 48 hours in advance.

-    Sessions canceled or rescheduled with less than 48 hours’ notice will be forfeited and considered used (not eligible for rescheduling or refund).

  • Coaching Package Cancellations & Refunds

-    1-Month Package: Non-refundable (except in the case of serious emergencies, e.g., illness, hospitalization, accident, and if cancellation is requested within 48 hours of purchase with no sessions or intake materials used.)

-    3-Month and 6-Month Packages:

o   The first month (or first payment) is non-refundable (except in the case of serious emergencies, e.g., illness, hospitalization, accident, and if cancellation is requested within 48 hours of purchase with no sessions or intake materials used.)

o   If canceling the package: sessions scheduled within 7 days of notice are non-refundable; all other unused sessions are eligible for refund.

-    Payment Plan Adjustments: For clients on installment plans, refunds will be calculated based on completed vs. unused sessions within the billing period.

-    All Packages: If cancellation is requested within 48 hours of purchase and no sessions or intake materials have been used, a full refund may be granted minus a $250 administrative fee, which includes scheduling, preparation, onboarding, and platform transaction costs (e.g., Squarespace/Stripe fees).

-    Please note: All approved refunds are subject to a $250 administrative fee, which covers scheduling, preparation, onboarding, and platform transaction costs (e.g., Squarespace/Stripe fees). Most platforms, such as Squarespace (via Stripe or PayPal), typically charge around 2.9% + 30¢ per transaction.
This policy protects the integrity of the coaching programs and ensures fair use of program commitments.

5. Intellectual Property

All materials on this Site including text, images, branding, and content are owned by or licensed to us and are protected by copyright and intellectual property laws. Do not use, download, share, or reproduce content without permission.

6. Acceptable Use

You agree not to:
- Misuse or hack the Site.
- Violate laws or regulations.
- Use Site content for commercial purposes without permission.

7. Data Collection Tools

Our site uses Squarespace and Google Analytics, which may collect user data (e.g., cookies, browsing behavior) for analytics and site functionality. See our Privacy Policy for details.

8. Disclaimers

All content and services are provided “as is” without warranties of any kind. We do not guarantee specific results from coaching, or any information shared on the Site.

By participating in coaching sessions, clients acknowledge that engagement is voluntary and undertaken at their own risk. Yildiz Oceanic Well-Being is not liable for any outcomes, decisions, or interpretations resulting from coaching services.

11. Legal Protections & Disclaimers

  • Right to Refuse Service: We reserve the right to refuse service to anyone for any reasons including, but not limited to, safety or policy violations, inappropriate behavior, or any conduct that compromises the safety, well-being, or integrity of the coaching environment.

  • Client Responsibility Clause: By engaging with our services, clients acknowledge full responsibility for their own health, decisions, actions, and well-being throughout the coaching process.

  • Testimonial Disclaimer: Results that may be shared in testimonials are personal to those individuals and are not guarantees of specific outcomes. Results will vary based on many individual factors.

12. Communication Boundaries

Communication outside of scheduled sessions (email/text) will occur with active clients for brief check-ins or follow-up, and individuals contacting about coaching services. Please allow 1-3 business days for a response. Coaching services do not provide crisis support. For urgent or emergency needs, please contact appropriate emergency services or a licensed mental health professional.

13. Technology/Platform Disclaimer

Virtual sessions are conducted via Zoom, Google Meet or similar video conferencing platforms. We are not responsible for technical difficulties, platform outages, or connectivity issues beyond our control.

14. Updates to Terms

These Terms may be updated periodically to reflect changes in services, policies, or legal requirements. Continued use of the site and services implies acceptance of the most recent version.
